Frequently asked questions about migration matters
An employer-sponsored visa enables businesses to sponsor highly qualified professionals from abroad to address specific labour shortages. This includes visas such as the Skills In Demand (SID) visa, Regional Sponsored Migration Scheme (RSMS) visa, and Employer Nomination Scheme (ENS) visa, which help companies attract and retain top global talent to support their growth and operational needs.
Labour agreements are tailored to address specific workforce needs that cannot be met through standard sponsorship. They provide flexibility in terms of occupation, English language proficiency, age limit and salary requirements.
Required documents vary depending on the visa type but generally include proof of identity, evidence of skills and qualifications, and compliance with health and character requirements.
Every visa has its own criteria, and each applicant of the family unit will need to go through an eligibility process (which can include - but is not limited to - age, health, police checks) before being added in the visa application.
Processing times vary depending on the visa type and individual circumstances. In practice, only the Department of Home Affairs can decide on an application, and they have discretion to ask for additional documentation. The DoHA’s processing time guide shows how long your visa application might take, based on recent processing times for similar applications.
A Registered Migration Agent (RMA) specialises exclusively in immigration law and visa processes. RMAs are registered with the Office of the Migration Agents Registration Authority (OMARA) and adhere to strict professional standards. They offer expert advice on visa options, eligibility, and application processes, making them an ideal choice for handling migration matters efficiently and effectively. Lawyers, on the other hand, can provide legal advice across a broader range of areas, including immigration, and can represent clients in court if necessary.
